In January 2017, Montana passed SB 25, which exempts fantasy sports leagues from the "gambling" classification provided the entry fee is no greater than $35, leagues last the whole season and prizes are of minimal monetary value.

The state's legislature put forth House Joint Resolution No. 21 in 2017, which seeks to evaluate and study daily fantasy sports in order to clarify its legality. The conclusion is expected on 15 September 2018.

In December 2018, two Montana lawmakers announced they were having bills drafted ahead of the 2019 session that would allow internet and mobile sports betting and kiosks at bars, restaurants and taverns. Montana, which was grandfathered in at the federal level to allow sports betting under the Professional and Amateur Sports Protection Act, doesn’t currently allow sports betting.
